Terms of Service & Tree Care Policies

Welcome to the website of Joe's Tree Care LLC (“Joe's Tree Care”, “we”, “us”, or “our”). By accessing our website, requesting tree service estimates, or authorizing arboricultural work on your property, you agree to be legally bound by these Terms of Service. Please read them thoroughly before authorizing project work.

1. Written Estimates & Scope of Work

All preliminary phone discussions, online form submissions, or photo reviews represent approximate budgetary ranges. Binding proposals are issued exclusively in writing following an in-person, on-site hazard and tree assessment by owner Joe or an authorized company arborist. Written proposals define the specific scope of tree removal, crown pruning, debris hauling, or stump grinding. Written estimates remain valid for thirty (30) calendar days from the date of issuance, provided site conditions, tree stability, and equipment access remain unchanged.

2. Property Ownership & Boundary Authorization

The client represents and warrants that they are the lawful title owner of the subject real property, or have obtained written legal authorization from the property owner to commission tree service. The client warrants that all marked trees, root zones, and access paths reside entirely within their deeded boundary lines or within documented easements. In the event of boundary disputes with neighboring property owners, the client agrees to hold harmless and indemnify Joe's Tree Care LLC against any third-party claims or civil disputes.

3. Equipment Access, Yard Safety & Private Utilities

Professional tree service requires heavy machinery, including aerial bucket trucks, mobile hydraulic cranes, tracked stump grinders, and high-capacity brush chippers. To ensure safe execution:

Yard Preparation: Clients must clear vehicles, recreational toys, outdoor furniture, potted plants, and pet waste from work drop zones and driveways prior to crew arrival.
Public Utilities (NC 811): Prior to subsurface stump grinding or trenching, our dispatch team notifies North Carolina 811 to mark public buried utilities (power, gas, municipal water, telecommunications).
Private Underground Installations: The client is strictly responsible for identifying and marking private subsurface lines, including septic drain fields, landscape lighting, invisible pet fencing, and lawn irrigation lines. We cannot be held liable for damage to unmarked private subsurface features.
Lawn & Turf Protection: We employ heavy-duty composite turf-protection mats to disperse equipment ground pressure; however, temporary soil indentation or turf flattening is common when moving multi-ton timber across damp Piedmont red clay.

4. Emergency Storm Response & Insurance Claims

Emergency tree services performed during or immediately following severe wind events, tropical storms, or winter ice storms focus on immediate life-safety hazards, home stabilization, and preventing progressive roof damage. Scope of emergency triage, emergency crane setup, tarping, and hazardous limb extractions are billed based on time, specialized equipment requirements, and debris tonnage. We provide itemized invoices, time logs, and photographic documentation suitable for submission to your homeowner insurance provider.

5. Inclement Weather & Safety Postponement

Arboricultural work involves high-voltage utility lines, slick bark, and high-wind dynamics. In accordance with ANSI Z133 safety mandates, Joe's Tree Care LLC reserves the right to postpone scheduled non-emergency work during active lightning, freezing rain, sustained winds exceeding 25 mph, or ground flooding that compromises machine stability. Postponed jobs will be rescheduled to the next available dry work window.

6. Payment Terms & Invoicing

Payment in full is due upon completion of the authorized work scope, unless explicit written insurance billing arrangements have been agreed upon prior to project start. We accept major credit cards, bank transfers, cashier's checks, and cash. Past-due balances exceeding thirty (30) days are subject to interest at the maximum rate permitted under North Carolina law.
